This page describes the disclosures and prior-express-written-consent ("PEWC") provisions that apply when you, as a consumer or prospective insured ("you"), provide your telephone number to NexLife ("NexLife," "we," "us," or "our") or to a licensed insurance agent ("Agent") who uses the NexLife platform to send you a secure intake link. This Consent is governed by, and intended to satisfy, the Telephone Consumer Protection Act of 1991, 47 U.S.C. § 227, and its implementing regulations at 47 C.F.R. § 64.1200 (collectively, the "TCPA"), as well as applicable state telemarketing, do-not-call, and SMS regulations.
1. What You Are Consenting To
By voluntarily providing your telephone number to NexLife or an Agent, including when you submit a web form on a NexLife-hosted page, fill out an intake link sent to you by an Agent, or otherwise share your number for the purpose of obtaining insurance quotes or completing an application, you give your prior express written consent to be contacted by:
- NexLife;
- The Agent who initiated contact with you and the Agent's licensed agency or upline;
- Insurance carriers to whom your application or intake is submitted; and
- Service providers acting on behalf of any of the foregoing (including SMS gateways and dialing platforms);
at the telephone number you provided, including by means of:
- Live telephone calls;
- Calls placed using an automatic telephone dialing system ("ATDS") or any other automated dialing technology;
- Calls or voicemails delivered using artificial or pre-recorded voice messages; and
- SMS and MMS text messages, including those sent through automated platforms.
2. Purpose of the Calls and Texts
The calls and texts authorized under this Consent may be made for purposes that include, without limitation: discussing life insurance products that may be appropriate for you, scheduling and confirming appointments, delivering secure intake links and one-time access codes, requesting clarifying information needed by an underwriter, providing status updates regarding your application, delivering policy documentation, soliciting referrals, conducting customer-satisfaction surveys, and offering related insurance products.
3. Consent Is Not a Condition of Purchase
You are not required to agree to this Consent as a condition of purchasing any goods or services. If you do not wish to receive autodialed or pre-recorded calls or text messages, do not submit your telephone number on a NexLife-hosted form, and instead contact NexLife or the Agent directly by email or postal mail.
4. Charges
Standard message and data rates charged by your wireless carrier may apply to text messages and to airtime used for voice calls. NexLife does not charge any separate fee for SMS or voice contact made under this Consent. Message frequency varies depending on your application activity; messages are sent only as needed to advance your inquiry.
5. Identification
Calls and texts authorized under this Consent will identify NexLife or the calling Agent's agency, will state the purpose of the call, and, in the case of pre-recorded voice messages, will provide a toll-free or other cost-free number that you may call to opt out of further calls.
6. How to Revoke Consent
You may revoke this Consent at any time and by any reasonable means, including:
- Replying STOP, END, QUIT, CANCEL, or UNSUBSCRIBE to any SMS message you receive from us or the Agent;
- Telling any caller, during a live call, that you wish to be placed on the internal do-not-call list;
- Sending an email to support@nexlifecrm.org with the subject line "Revoke TCPA Consent" and the phone number you wish to remove;
- Sending written notice by U.S. mail to: NexLife, Compliance, Michigan, USA.
We will honor your revocation within a reasonable time, not to exceed ten (10) business days from the date of receipt. Revocation will apply to all telephone numbers you have provided unless you specify otherwise. Transactional messages strictly necessary to wind down or service a pending application or in-force policy may continue for a brief period after revocation.
7. Internal Do-Not-Call Policy
NexLife maintains a written internal do-not-call ("IDNC") policy, available on request by emailing compliance@nexlifecrm.org. Personnel involved in placing calls or texts on behalf of NexLife are trained on the TCPA, the IDNC policy, and the maintenance of suppression lists. We scrub outbound contacts against the federal National Do Not Call Registry where applicable and against our IDNC suppression list before each campaign or send.
8. State-Specific Disclosures
Some states impose additional restrictions on telemarketing and automated calls or texts, including without limitation Florida (Fla. Stat. § 501.059), Oklahoma (the "Mini-TCPA"), Washington (RCW 80.36.400), and similar statutes in other states. To the extent any provision of those statutes provides you with greater rights than the TCPA, those rights apply. By providing your phone number you also consent, to the maximum extent permitted by applicable state law, to receive the calls and texts described in this Consent under those state statutes.
9. Records of Consent
When you provide consent through a NexLife-hosted form or intake, we capture and retain a record of the consent, including a timestamp, the IP address of the device from which consent was given, the user-agent string of that device, and the exact text of the consent language presented to you at the moment of consent. We retain these records for at least four (4) years from the date consent was last refreshed, or for the longer period required by applicable law, for evidentiary and audit purposes.
10. Misrepresentation
You represent that the telephone number you provide is your own number, or is a number for which you have authority to grant consent, and that you will promptly notify us if you no longer have that authority. Providing a telephone number that is not yours, or that you are not authorized to enroll in communications, is a violation of these terms and of law.
11. Changes to This Consent
We may update this TCPA Consent from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes affecting the scope of consent will be communicated before they take effect; you will have the opportunity to revoke consent prior to the effective date.
